Parents and guardians are responsible for monitoring their children's use of the app and the content generated. This service is designed for parents and caregivers to use with children under their supervision.
We will provide our services to you subject to the conditions stated below. By accessing or using this app or web service, you consent to these terms and conditions. This is why we urge you to read them carefully. If you do not agree to these terms, please refrain from using the Twinkle Timer app or web service.
All communication with us is electronic. By using the app or web service, or by sending communications to us via email or through the app, you consent to receive electronic communications from us. You agree that all agreements, notices, disclosures, and other forms of communication that we provide to you electronically satisfy any legal requirement that such communications be in writing.

Image generation relies on third-party AI services (Google Gemini and OpenAI) that may occasionally experience technical issues, outages, or failures. You acknowledge and agree that:
While we have taken reasonable precautions to ensure reliable service and minimize generation failures, technical issues may occur. We continuously work to improve reliability and handle errors gracefully, but we cannot guarantee 100% success rate for AI image generation.
We are not responsible for any payments made through the mobile application or web service. Payments and transactions are processed by the Apple App Store, Google Play Store, or our payment processor. We do not have control over refunds or disputes related to these transactions. Therefore, any issues or disputes involving payments must be raised directly with the platform used to make the purchase.
Our Privacy Policy governs the use of the Twinkle Timer app and web service and explains how we collect, safeguard, and disclose information that results from your use of our service. By using this app or web service, you also agree to allow us to process your data under the terms of our Privacy Policy.
You retain all rights to the photos you upload to Twinkle Timer. By using the service, you grant us a limited license to process your photos solely for the purpose of generating AI images as part of the service. We do not claim ownership of your photos or generated images.
By using the Twinkle Timer app or web service, you agree that the laws of Norway, without regard to principles of conflict of laws, govern these Terms of Service and any disputes that might arise between you and Knauken AS, or its partners and affiliates.
Any dispute related in any way to your use of the Twinkle Timer app or web service, or to purchases or usage of features within the app, shall be subject to the jurisdiction and venue of the courts in Norway. By using the app or web service, you consent to the exclusive jurisdiction of such courts.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account or any other breach of security. We cannot and will not be liable for any loss or damage arising from your failure to comply with this security obligation.
The Twinkle Timer app and web service are provided "as is" without warranties of any kind. We do not guarantee that the service will be error-free or uninterrupted. We are not liable for any damages arising from your use of the service, including but not limited to issues with AI-generated content, data loss, or service interruptions.
To the maximum extent permitted by applicable law, in no event shall Knauken AS be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the service.
You agree to indemnify, defend, and hold harmless Knauken AS, its officers, directors, employees, agents, and third-party service providers from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from: (a) your use of the service; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property rights or privacy rights; or (d) any content you submit through the service.
We reserve the right to modify these Terms of Service at any time. When we make changes, we will update the "Last updated" date at the bottom of this page. We will notify you of material changes by posting a notice on our website or through the app. Your continued use of the service after any changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the service.
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if such modification is not possible, it shall be severed from these Terms. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of any other provision, and the remaining provisions shall continue in full force and effect.
We reserve the right to terminate or suspend your account and access to the Twinkle Timer app or web service at our sole discretion, without notice, for any reason, including but not limited to breach of these Terms of Service.
